By accessing or using BePasal ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not use the Platform. These Terms constitute a legally binding agreement between you and BePasal. We reserve the right to update these Terms at any time, and we will notify you of material changes via email or through the Platform.

BePasal is a social commerce platform that provides tools for Instagram and WhatsApp sellers to manage and grow their businesses. Our services include:

To use BePasal, you must create an account and provide accurate, complete information. You are responsible for:

• Maintaining the confidentiality of your login credentials.
• All activity that occurs under your account.
• Notifying us immediately of any unauthorized access or security breach.
• Ensuring that you are at least 18 years old or have legal parental consent.

4. Payment Terms

BePasal operates on a subscription-based pricing model. By subscribing to a paid plan, you agree to the following:

• All prices are listed and charged in Nepalese Rupees (NPR).
• Subscriptions are billed on a recurring monthly or annual basis depending on your selected plan.
• Payments are processed through eSewa, Khalti, or other payment methods available on the Platform.
• We reserve the right to change pricing with 30 days advance notice. Price changes will take effect at the start of your next billing cycle.
• Failure to pay may result in suspension or termination of your account.

5. Acceptable Use

You agree not to use BePasal for any purpose that is unlawful or prohibited by these Terms. Specifically, you shall not:

• Sell counterfeit, illegal, or prohibited goods through the Platform.
• Use the Platform to send spam, harass users, or distribute malware.
• Attempt to reverse engineer, decompile, or extract source code from the Platform.
• Interfere with or disrupt the integrity or performance of the Platform.
• Misrepresent your identity or impersonate any person or entity.

6. Intellectual Property

The BePasal platform, including its design, code, features, logos, and content, is the intellectual property of BePasal and is protected by applicable copyright and trademark laws.

You retain ownership of all content you upload to the Platform, including product images, descriptions, and store data. By using BePasal, you grant us a limited license to host, display, and process your content solely for the purpose of providing our services.

7. Limitation of Liability

To the maximum extent permitted by applicable law, BePasal shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages.
• Loss of profits, data, or business arising from your use of the Platform.
• Service interruptions, downtime, or third-party integration failures (including payment gateway outages).
• Disputes between sellers and their customers.

Our total liability shall not exceed the amount you paid to BePasal in the 12 months preceding the claim.

8. Termination

You may cancel your account at any time from your dashboard settings. Upon cancellation:

• Your access to paid features will continue until the end of your current billing period.
• Your store data will be available for export for 30 days after cancellation.
• After 30 days, your data will be permanently deleted.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or remain inactive for an extended period.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Nepal. Any disputes arising from these Terms or your use of the Platform shall be resolved through the courts of Nepal. Both parties agree to attempt good-faith negotiation before pursuing formal legal action.
